Explanation on the progress of the series of cases concerning Mr. Wang Yibo’s reputation rights

In response to the malicious defamatory of the reputation of our artist Mr. Wang Yibo by certain Internet users, our company resolutely withhold the legal rights and interests of Mr. Wang Yibo, actively defending his rights through legal channels. At present, our company shall provide the explanations on the progress of the three following defamation cases that have been judged so far:

1. Tang *jiao (weibo nickname “Liyuan Jiangzhao”, UID: 5575822988, the account currently is deactivated) Reputation Infringement

On September 4 and September 5, 2019, Tang *Jiao registered and used a Sina Weibo account (UID: 5575822988) nicknamed “Liyuan Jiangzhao” and on the “Sina Weibo” website (registered domain name: weibo.com), published several posts directing against Mr. Wang Yibo.

The posts contained a large number of insulting remarks against Mr. Wang Yibo, which caused extremely negative effects to Mr. Wang Yibo and constituted an infringement of Mr. Wang Yibo’s reputation. In order to protect the legal rights and interests of Mr. Wang Yibo, our company and Mr. Wang Yibo entrusted a lawyer to file a lawsuit in the court according to law.

The court judged that freedom of speech is a basic right enjoyed by citizens, but in expressing one’s opinions, insulting comments should not be used to attack others, and derogatory or degrading words should not be used to improperly characterize others.

The defendant Tang *Jiao’s personal attacks on Wang Yibo were very obvious, which exceeded the scope of the law which protect a citizens’ freedom of speech, and is judged to be an insult, and should bear the corresponding liability.

Therefore, the court ordered the defendant Tang *Jiao to issue a statement on her Weibo account within 7 days from the effective date of the judgment to apologize to the plaintiff Wang Yibo, and to compensate the plaintiff Wang Yibo for corresponding economic losses and mental damages.

2. Liang *ling (Weibo is called “Yao Yao Yao Ma”, once used name: “Yao Yao Zero” UID: 6196126055) Reputation Infringement

On September 5, 2019, Liang *Ling registered with the Sina Weibo account (UID: 6196126055) nicknamed “ー妖妖妖-” (former name: “一妖妖零吗-“) on the “Sina Weibo” website (registered domain name: weibo.Com) and published several posts directed against Mr. Wang Yibo.

The posts contained a large number of insulting remarks against Mr. Wang Yibo, which caused extremely negative effects to Mr. Wang Yibo and constituted an infringement of Mr. Wang Yibo’s reputation. In order to protect the legal rights and interests of Mr. Wang Yibo, our company and Mr. Wang Yibo entrusted a lawyer to file a lawsuit in the court according to law.

The court judged that Liang *ling’s remarks on her Weibo account had very obvious cursing and insulting comments, and were accompanied by an edited picture of Wang Yibo’s portrait. The intention to attack Wang Yibo was relatively obvious, which exceeded the scope of a citizens’ freedom of speech rights. Freedom of speech is a basic right enjoyed by citizens, but when making a statement, the content should be basically or roughly true, and no false information should be fabricated and spread.

Liang *ling’s actions constituted as slandering or slander based on false facts disseminated by others that were not conducive to Wang Yibo’s and is judged to be defamatory, which harmed Wang Yibo’s reputation and should bear the corresponding liability.

Therefore, the court ordered the defendant Liang *Ling in within 7 days from the effective date of the judgment, to issued a statement on his weibo account apologising to the plaintiff Wang Yibo and compensate the plaintiff Wang Yibo for corresponding economic losses and mental damages.

3. Mao *ling (weibo nickname “passerby oo0oo000o,” UID: 55540932241) Reputation Infringement

From May to August 2020, Mao *ling registered on weibo with the name “passerby oo0o00000,” Weibo account (UID: 55540932241), and published several posts against Mr. Wang Yibo on the “Sina Weibo” website (registered domain name: weibo.com).

The posts contained a large number of insulting remarks against Mr. Wang Yibo, which caused extremely negative effects to Mr. Wang Yibo and constituted an infringement of Mr. Wang Yibo’s reputation. In order to protect the legal rights and interests of Mr. Wang Yibo, our company and Mr. Wang Yibo entrusted a lawyer to file a lawsuit in the court according to law.

The court judged that citizens enjoy the right to their reputation and that their personal dignity is protected by law. It is forbidden to use insults, slander, etc. to damage the reputation of citizens. If the perpetrator infringes on the reputation of others due to his fault, he shall bear the liability.

Defendant Mao *Ling made insulting verbal attacks on the plaintiff Wang Yibo on her personal Weibo account, causing the plaintiff to had a certain degree of negative impact on his social evaluation and psychological emotions, the court found that the defendant Mao *Ling’s behavior had violated the plaintiff Wang Yibo’s reputation rights.

Therefore, the court ordered the defendant Mao *Ling to post an apology to plaintiff Wang Yibo within 7 days of the effective date of the judgment, pinning it in the top position of her Weibo page, and to compensate the plaintiff Wang Yibo for the corresponding economic losses and mental damages. After the judgment of the first instance was made, the defendant Mao *Ling filed an appeal.

On November 29, 2021, the court of second instance made a final judgment according to law: the appeal is overruled and the the original judgment is upheld.

After all judgments in the above three cases are fulfilled, Mr. Wang Yibo will donate all the compensation he received. In the follow-up, our company will pay close attention to the implementation of the above-mentioned judgment and donate on behalf of Mr. Wang Yibo.

In addition to the above cases, our company found that some netizens maliciously published many defamatory remarks against Mr. Wang Yibo, including but not limited to “being prosecuted for suspected fraud“, etc., maliciously fabricated and disseminated false information related to criminal crimes of another Mr. Wang of the same name in other cases and has seriously misled the public, resulting in a serious negative impact on Mr. Wang Yibo’s social evaluation.

In this regard, our company has also commissioned Beijing Xingquan Law Firm to investigate and collect evidence on the above-mentioned infringements, and will take legal measures against relevant subjects who are still going on with the infringement, to pursue their corresponding legal liabilities, and resolutely safeguard the Mr. Wang Yibo rights and interests.

The Internet is not outside of the law.

Any subject should establish a bottom line by the law when making relevant remarks, and actively respond to the “qinglang” carried out by the Central Cyberspace Administration of China. Do not spread rumours and respect the legal rights and interests of others, and jointly maintain a civilized and healthy cyberspace.
